Acceptable Use Policy and Internet Access Agreement is
structured with the following objectives:
1. Necessitate security, reliability
and privacy of GatewayONE
systems and
network.
2. Preserve privacy and security of end
users.
3. Promote and ensure responsible use
of the Internet and network
resources.
4. Facilitate indemnification of
GatewayONE from potential legal
liability.
1.
Customers shall not utilize GatewayONE network for transmission
of material that deems obscene, threatening, abusive or in
anyway violates any local, state, federal or international law.
2.
Customers shall not abuse GatewayONE network and its resources
in any way, shape or form.
3.
Customers shall not engage in any form of SPAM/UCE (Unsolicited
Commercial Email)/UCB (Unsolicited Commercial Bulk Mail).
4.
GatewayONE shall not be liable for the content from end users
nor any transmission through GatewayONE network.
5. Any materials, data, email that deems unfit or poses
security threats to GatewayONE network shall be deleted and
prevented from entering GatewayONE network without any
notifications
6. GatewayONE will cooperate fully with aLL law enforcement agencIES
regarding any suspected criminal activity or violations of
network security.
DISCLAIMER OF
LIABILITY
1. YOU AGREE THAT YOUR USE OF THE ACCESS
SERVICE, AND THE INTERNET IS SOLELY AT YOUR OWN RISK. YOU AGREE
THAT THE ACCESS SERVICE IS PROVIDED ON AN "AS IS," "AS AVAILABLE"
BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
2. EXCEPT TO THE EXTENT THAT SUCH DISCLAIMERS ARE EXPRESSLY
PROHIBITED BY LAW, GATEWAYONE DISCLAIMS ANY AND ALL LOSS, DAMAGE
OR LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE ACCESS
SERVICE, INCLUDING, BUT NOT LIMITED TO, ANY LOSS, DAMAGE OR
LIABILITY RELATING TO: (A) LOSS OR CORRUPTION OF DATA; (B) LOSS OF
OR DAMAGE TO SOFTWARE OR HARDWARE; (C) ACCESS DELAYS OR ACCESS
INTERRUPTIONS; (D) COMPUTER VIRUSES; (E) NON-DELIVERY OR
MIS-DELIVERY OF DATA; (F) THE NEGLIGENT ACTS AND/OR OMISSIONS OF
GATEWAYONE OR GATEWAYONE SUBSCRIBERS; (G) ANY DEFECTS, FAILURES,
ERRORS, OMISSIONS, OR MISSTATEMENTS IN ANY AND ALL INFORMATION,
GOODS, OR SERVICES OBTAINED ON OR THROUGH THE ACCESS SERVICE, AND;
(H) LOSS OR LIABILITY RESULTING FROM ACTS BEYOND GATEWAYONE’S
CONTROL.
3. UNDER NO CIRCUMSTANCES SHALL GATEWAYONE, ITS
SUBSIDIARIES, OR ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT,
PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT
RESULT FROM THE USE OF, OR INABILITY TO USE, THIS SITE AND
SERVICE. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS
BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY
OTHER BASIS, EVEN IF GATEWAYONE HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGE.
LIMITATION OF
LIABILITY & INDEMNIFICATION
1. You agree that
GATEWAYONE’s entire
liability, and your exclusive remedy, with respect to your use of
thE Service, and any breach of this Agreement is solely limited to
the PRO-RATA amount you paid to use the Service.
2. You
agree to defend, indemnify, and hold harmless GATEWAYONE and its
subsidiary and other affiliated companies, and their employees,
contractors, officers, and directors from all liabilities, claims,
and expenses, including attorney's fees, that arise from your use
or misuse of this sERVICE. |
